Parking issues and vehicles causing an obstruction


Dear Resident,

The Ashton Hurst Neighbourhood team have been informed by a number of resident’s regarding their concerns about the parking around the junctions of St Albans Ave, Lichfield Ave and Winchester Ave.
We want to remind residents who own a motor vehicle, of their responsibilities as a UK driving license holder regarding parking.

The Highway Code states:

Rule 242
You MUST NOT leave your vehicle or trailer in a dangerous position or where it causes any unnecessary obstruction of the road.
Laws/Legislation that cover this are The Road Traffic Act 1988 Sec 22 & The Roads Vehicles (construction and use) Regulations 1986.

Police Officers & Police Community Support Officers (PCSO) have the power to issue a Traffic Offence Report (TOR) which can lead to a Penalty Charge Notice (PCN).
Police Officers & Police Community Support Officers also have the power to remove vehicles that are causing unnecessary obstruction of the road.

Please note the pavement is also classed as the Road/Highway, and members of the public have the right to safely use the Road/Highways. Members of the public should not be forced into the road and should be allowed to use the pavement.

If you have to park half on the pavement and half on the road for whatever reason, we advise to make sure that a wheelchair or a double pram/buggy can pass your vehicle with ease.
Parking fully on the pavement should be avoided.


Rule 243
DO NOT stop or park:
Opposite or within 10 metres (32 feet) of a junction, except in an authorised parking space.
Whilst this is an advisory and there is no specific Law/Legislation specific to this issue, please remember that your vehicle could still be causing unnecessary obstruction of the road.
